Welcome to PixelPerfect. These Terms of Service ("Terms") govern your use of our website, products, and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By accessing or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting on this website. Your continued use of this website after such modifications will constitute your acknowledgment and acceptance of the modified terms.

2. Description of Services

PixelPerfect provides web design, UI/UX development, and related digital services. We create and implement designs for websites, applications, and games, including but not limited to:

Website UI/UX design and development
Mobile application interface design
Game interface design (including Plinko and other games)
Responsive design implementation
Design systems development
User testing and research
Accessibility consulting

The specific services provided will be outlined in the service agreement between PixelPerfect and the client.

3. User Accounts

Some portions of our services may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

4. Intellectual Property Rights

All content included on this website, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the website, is the property of PixelPerfect or its suppliers and protected by copyright and intellectual property laws.

Upon full payment for services, clients will receive rights to the final deliverables as specified in their individual service agreements. Unless explicitly stated otherwise in the service agreement:

PixelPerfect retains ownership of all preliminary designs and concepts not selected for final delivery
PixelPerfect reserves the right to display and link to your completed project as part of our portfolio and to write about the project on websites, in articles, and in books about design
PixelPerfect retains intellectual property rights to components of our work that were created prior to the project and may be reused in other projects

5. Client Responsibilities

To ensure the successful completion of projects, clients are expected to:

Provide timely and accurate information, materials, and feedback necessary for project completion
Review and approve work at designated project milestones
Make payments according to the agreed schedule
Obtain any necessary third-party permissions for materials provided to us
Comply with all applicable laws and regulations regarding the use of our services and deliverables

6. Payment Terms

Payment terms are specified in individual service agreements. Generally, unless otherwise agreed:

A non-refundable deposit of 50% is required to commence work
The remaining balance is due upon project completion and before the transfer of deliverables
Additional services requested outside the original scope will be billed separately
Late payments may incur additional fees and/or interest charges

All prices are displayed in Euro (€) unless otherwise specified.

7. Project Timelines and Deliverables

Project timelines will be established in the service agreement. PixelPerfect will make reasonable efforts to meet agreed deadlines, but is not responsible for delays caused by client factors, including but not limited to delayed feedback, changes to project scope, or failure to provide necessary materials.

Deliverables will be provided in standard formats as specified in the service agreement. We do not guarantee compatibility with all platforms or future technologies unless explicitly stated.

8. Changes and Revisions

We understand that design is an iterative process. Our service packages include a specified number of revision rounds. Additional revisions or changes to the project scope may incur additional charges at our standard hourly rates.

Substantial changes to project requirements after work has commenced may require a reassessment of timelines and costs.

9. Termination

Either party may terminate a project under the conditions specified in the service agreement. In the event of termination:

The client is responsible for payment for all work completed up to the termination date
The initial deposit is non-refundable
PixelPerfect will provide all completed deliverables upon full payment of outstanding balances
PixelPerfect reserves the right to terminate services if the client breaches these Terms or the service agreement

10. Limitation of Liability

PixelPerfect will not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your use or inability to use our services
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from our services
Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party

Our total liability for any claims under these Terms shall not exceed the amount you paid us for the applicable service.

11. Indemnification

You agree to defend, indemnify and hold harmless PixelPerfect and its employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

Your use of and access to our services
Your violation of any term of these Terms
Your violation of any third-party right, including without limitation any copyright, property, or privacy right
Any claim that content you provided caused damage to a third party

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or services following the posting of any changes to these Terms constitutes acceptance of those changes.
